Possibility for company directors to request the concealment of their personal address in the Trade and Companies Register (RCS)

The publication of Decree No. 2025-840 of 22 August 2025 (https://www.legifrance.gouv.fr/jorf/id/JORFTEXT000052130299) in the Official Journal opens the possibility for company directors to request the concealment of their personal address in the Trade and Companies Register (RCS).

Indeed, until now, the personal addresses of company directors systematically appeared in public documents, in particular on the company’s K-bis extract.

This new procedure therefore represents a significant step forward in the protection of company directors’ privacy, while nevertheless seeking to remain consistent with the requirements of economic transparency.

I.  Persons concerned

Pursuant to the new Article R. 123-54-1 (by reference to Article R. 123-54 of the French Commercial Code), the following natural persons holding responsibilities within companies may be eligible to request the redaction of their personal address:

  • corporate officers: managers, chairpersons, chief executive officers, deputy chief executive officers, and members of the management board, depending on the company’s legal form;
  • partners and third parties vested with the power to habitually direct, manage or bind the company;
  • partners with unlimited or joint liability for the company’s debts: partners of civil companies, partners of general partnerships (sociétés en nom collectif), and general partners of limited partnerships (sociétés en commandite).

However, the professional address remains visible, thereby ensuring the transparency necessary for the proper functioning of business life.

II. Procedure

 

A)     Application through the Guichet unique

The procedure is carried out online via the unique counter (Guichet unique), the new centralized service for business administrative formalities.

The request for the concealment of the personal address may be made in two different ways:

  • Independently of any filing, the director may submit the request at any time ;
  • When carrying out a filing with the Trade and Companies Register (RCS), the director may submit the request simultaneously with such filing.

B) Différent concealments

There are two scenarios in which the personal address of the company director can be concealed:

  • Concealment on the K-bis extract: the personal address of the company director will be removed from the K-bis extract issued to the public;
  • Concealment in documents filed with the Trade and Companies Register (RCS)

A redacted version will be published in place of the original for any document already filed that includes the manager's personal address.

 

III. Restricted access

The original document will be kept as supporting evidence, but will not be accessible to the public, except in certain specific cases (Article L. 123-53 of the Commercial Code).

Although this measure is intended to protect the privacy of directors, access to redacted addresses remains possible for certain authorities and professionals for legal and regulatory purposes, such as:

  • Judicial authorities, customs officers, public finance officers, and judicial police officers.
  • Notaries, bailiffs, and judicial administrators may also have access to this information in the course of their duties.
  • Creditors, under certain conditions, may also consult addresses that are not hidden if they have claims related to the management of the company.
